O R D E R

 

WHEREAS the West Bengal Pollution Control Board (hereinafter for the sake of brevity and convenience referred to as the `State Board'), is executing and implementing different Environmental Laws for abatement of pollution within the territorial jurisdiction of the State of West Bengal ;

AND WHEREAS it is observed that within the State of West Bengal, a number of sponge iron units have been established and operating and during operation of such sponge iron units serious pollution problems are generated from their manufacturing process;

AND WHEREAS it is observed that despite the erection of pollution control system, sponge iron units are not operating their pollution control systems as revealed time and again by surprise inspections by the State Board officials ;

AND WHEREAS it is observed that sponge iron units are dumping their wastes generated from their manufacturing process indiscriminately in the surrounding areas which is a serious concern for environmental degradation ;

Considering the aforementioned scenario and in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder, the sponge iron units are hereby directed to comply with the following directions apart from other directions already issued by the State Board :-

  1.  
    1. All sponge iron units should operate maintaining the environmental norms; All units should submit copy of service contract for operation and maintenance of pollution control devices ;

    2. All sponge iron units should not start their production even on trial basis without obtaining 'Consent to Operate' of the State Board ;

    3. No entrepreneurs should make any attempt to establish any sponge iron unit within the State of West Bengal; without obtaining 'Consent to Establish' of the State Board ;

    4. All the existing sponge iron units, which have already valid 'Consent to Operate' of the State Board should install dedicated energy meters for emission control equipments within March, 2005 and the upcoming units should not start their production without installing dedicated energy meter for their emission control equipments ;

    5. All the existing sponge iron units should commission inter-lock system between the emission control system and rotary kilns within July, 2005 and the up-coming sponge iron units should not start production without installing inter-lock system between emission control equipments and rotary kilns ;

    6. All the sponge iron units should arrange for disposal of their wastes coal/dolochar in abandoned open cast mine pits within March, 2005 and the up-coming sponge iron units should before starting production also arrange for disposal of their wastes in abandoned open cast mine pits, with prior approval of the competent authority.

In case of non-compliance of the aforementioned directions the State Board will issue regulatory order, including closure and disconnection of electricity, and also impose Bank Guarantee/pollution cost.
