CONSENT TO OPERATE

Running units and the units starting operation after establishing as per NOC issued by the Board have to apply for consent to operate.Depending upon the pollution and hazard potential of industrial activities, the industries are categorised as   red , orange,  green, white and exempted. There are siting restrictions for these industries. The  Board, considering compliance of environmental laws by the industry issues consent to operate to the industry. 

 [Consent to Operate to be renewed periodically, renewal application to be submitted 120 days prior to the expiry of previous certificate]

The power to grant consent to operate is furnished below:

Application fee depends on the Gross Capital Investment on land, building and plant machinery of the project.

Green - 7 years

Orange - 5 Years

Red - 5 Years

 


Green (Medium Scale), Orange & Red (All Small & Medium Scale units other than EC attracting units) -- Both Fresh and Renewal

All Large Scale units including EC attracting units - Renewal

For obtaining Consent to Operate from the Board, the entrepreneurs are required to apply online (http://emis.wbpcb.gov.in) Some of the important documents required to be submitted along with the application form are as follows.

 

Documents

  • Paid Bank Challan for depositing fees (3rd copy)
  • Any land related document (rent agreement, rent receipt, land deed, porcha, lease document as applicable)
  • Gross Capital Investment Certificate (Self certified undertaking)
  • Self certified site plan/lay out with road map/route map
  • Project Report with details of emission, effluent, solid waste management plan, raw materials, finished products, manufacturing process including list of machinery
  • Copy of Consent to Establish (NOC) Certificate (for Fresh Consent to Operate applications)
  • Test Reports for emission/effluent (done within last one year)
