Plastic Waste Management

In addition to solid waste as defined in the Solid Wastes Management Rules, 2016, a lot of plastic wastes are also generated from households, industries and commercial activities.Most of these plastic wastes find their way to illegal recyclers or municipal dumps or open drains.

Plastic waste is regulated as per the provisions of the Plastic Waste Management Rules, 2016 that were notified in March 2016.

As per the rules, the responsibility of enforcement of the rules lies with several authorities - each having specific duties :-

Every local body is responsible for development and setting up of infrastructure for segregation, collection, storage, transportation, processing and disposal of the plastic waste either on its own or by engaging agencies or producers.

The WBPCB is responsible for enforcement of the provisions of these rules relating to registration, manufacture of plastic products and multilayered packaging, processing and disposal of plastic wastes.

The Secretary-in-charge of Urban Development of the State is the authority for enforcement of the provisions of these rules relating to waste management by waste generator, use of plastic carry bags, plastic sheets or like, covers made of plastic sheets and multilayered packaging.

The concerned Gram Panchayat is the authority for enforcement of the provisions of these rules relating to waste management by the waste generator, use of plastic carry bags, plastic sheets or like, covers made of plastic sheets and multilayered packaging in the rural area of the State

The authorities referred shall take the assistance of the District Magistrate or the Deputy Commissioner within the territorial limits of the jurisdiction of the concerned district in the enforcement of the provisions of these rules

The WBPCB is responsible for granting Registration to manufacturers of plastic raw materials, producers who use the plastic raw materials to make sheets, carry bags and multilayer packaging, producers or brand owners who use plastic sheets, films etc. for packaging their products and recyclers who recycle or process such wastes. The Board cannot renew registration of producer unless the producer possesses an action plan endorsed by the Secretary in charge of Urban Development of the State for setting of plastic waste management system.

Further, Producers, Importers and Brand Owners who introduce the products in the market are primarily responsible for collection of used multi-layered plastic sachet or pouches or packaging and therefore they need to establish a system for collecting back the plastic waste generated due to their products. This plan of collection is required to be submitted to the Board while applying for Consent to Establish or Operate.
