Appeal No.A-38/2002 (Indian Oil Corporation Ltd., Vs. W.B. Pollution Control Board)

The appellant unit preferred an appeal against the regulatory order of the State Board for forfeiture of Bank Guarantee to the tune of Rs.5,00,000/- from the Bank Guarantee already executed and for execution of further Bank Guarantee to the tune of Rs.15,00,000/- for environmental degradation made by the appellant unit through spillage of oil.

Hon’ble Appellate Authority only stayed the order for further Bank Guarantee of Rs.15,00,000/-.

Hon’ble Appellate Authority directed the State Board to encash Rs. 5,00,000/- from the Bank Guarantee amount already executed and the fate of such forfeiture be decided subject to disposal of the appeal.

On perusal of reports and records submitted by the State Board, the appellate Authority was pleased to constitute a Committee to assess the damage caused because of pollution. The Committee constituted includes :

  1. Prof. Dipak Bhattacharyya, Raja Bazar Science College, Calcutta University.
  2. An Officer from the State Pollution Control Board;
  3. An Officer from the Central Pollution Control Board;
  4. Sr. Law Officer, W.B. Pollution Control Board to act as Convenor of the Committee.

Appeal No.A-38/2002 (Indian Oil Corporation Ltd., Vs. W.B. Pollution Control Board)

Pursuant to above mentioned appeal M/s. Indian Oil Corporation submitted before the Hon’ble Appellate Authority that all works relating to pollution control will be completed before June 2003 before the monsoon starts. Hon’ble Appellate Authority desired that the Expert Committee accompanied by the officers of the West Bengal Pollution Control Board should visit to monitor the compliance. It was also noted that apart from IOCL, other industries like Consolidated Fibres and Chemical Limited, Hindustan Lever and Shaw Wallace, etc. are also discharging effluent into the Green Canal. Hon’ble Appellate Authority directed the State Board to investigate the matter from environmental point of view to ascertain the nature and character of discharge as also whether such industries are maintaining effluent treatment plant in accordance with norms. Such industries were

also directed to extend all necessary assistance to State Board officials for the purpose of inspection.

Hon’ble Appellate Authority considered that one of the members of the Expert Committee appointed by the Hon’ble Appellate Authority namely Prof. Dipak Bhattacharya, has been nominated by the State Government as one of the members of the Appellate Authority.

In view of this, the Hon’ble Appellate Authority reconstituted the Expert Committee to monitor the compliance of the Environmental norms by M/s. IOCL (Haldia Refinery) who will visit the spot and submit report before the Appellate Authority on 22nd July 2003. The names of the members are as follows:

  1. Prof. Robin Majumdar, Prof. of Chemical Technology Department, University College of Science at Rajabazar, Kolkata;
  2. Prof. Siddhartha Dutta, Chemical Engineering Department, Jadavpur University;
  3. Sri B. R. Naidu, Sr. Environmental Engineer, In-Charge of Central Pollution Control Board Eastern Zonal Office;
  4. Sri Subrata Ghosh, Sr. Environmental Engineer, West Bengal Pollution Control Board; and
  5. Sri Biswajit Mukherjee, Sr. Law Officer, West Bengal Pollution Control Board as Member-Convenor of the Committee.
